This Privacy Policy explains how Inclusive Consulting, doing business as Phoneless(“we”, “us”, or “our”), collects, uses, and shares information when you use the Phonelesssoftware and websites (the “Service”). By using the Service, you agree to this Policy.
1. Information we collect
We collect the following categories of information:
- Account information — such as your name, email address, phone number, business name, and login credentials, which you provide when you sign up.
- Billing information — subscription plan and payment status. Card payments are processed by Square; we do not store your full card number. Square handles card data under its own privacy policy.
- Connected-account data — when you connect a third-party platform such as GoHighLevel, we access the data you authorize (for example, contacts and conversations) to provide the Service.
- Messaging data — metadata and content of messages you send and receive through the Service (such as phone numbers, timestamps, and delivery status), which we process to operate the Service and show you your conversations and reporting.
- Usage & device information — logs, IP address, browser type, and similar technical data generated when you use the Service.
2. How we use information
- To provide, operate, secure, and improve the Service;
- To process subscriptions and payments and to send you related notices;
- To provide customer support and respond to your requests;
- To detect, prevent, and address fraud, abuse, security, or technical issues; and
- To comply with legal obligations and enforce our Terms of Service.
We do not sell your personal information.
3. Your contacts’ information (you are the controller)
When you use the Service to message your own contacts, you decide who to contact and what to send. As to that contact data, you are the data controller and we act as your processor, handling it on your behalf and per your instructions. You are responsible for having a lawful basis and any required consent to process and message your contacts, and for providing them any privacy notices the law requires.
4. How we share information
We share information only as needed to run the Service:
- Service providers — such as our hosting/infrastructure provider, our payment processor (Square), and platforms you connect (such as GoHighLevel), who process data on our or your behalf.
- Legal & safety — when we believe disclosure is required by law or necessary to protect rights, safety, or the integrity of the Service.
- Business transfers — in connection with a merger, acquisition, or sale of assets, subject to this Policy.
5. Data retention
We retain information for as long as your account is active and as needed to provide the Service, comply with our legal obligations, resolve disputes, and enforce our agreements. You may request deletion of your account data as described below; some records may be retained where required by law.
6. Security
We use reasonable administrative, technical, and organizational measures designed to protect information, including encryption of sensitive credentials at rest. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
7. Your choices & rights
You may access or update your account information in the app, and you may request that we correct or delete your personal information by contacting us. Depending on where you live, you may have additional rights under applicable privacy laws; we will honor those rights as required.
8. Cookies
We use strictly necessary cookies (such as a session cookie) to keep you signed in and to operate the Service. Disabling these may prevent the Service from working.
9. Children
The Service is for business use and is not directed to children. We do not knowingly collect personal information from anyone under 18.
10. Changes to this Policy
We may update this Policy from time to time. We will revise the “Last updated” date above and, for material changes, take reasonable steps to notify you.
